The current legal landscape

Daily fantasy sports occupy a regulated middle ground between casual fantasy and sports betting. Most states classify paid DFS as a game of skill and license operators accordingly; a minority either restrict it to certain operators or do not permit paid contests at all. Because state legislatures revisit these rules regularly, our table reflects a general August 8, 2026 snapshot and should always be re-checked against the operator's own state list at sign-up.

Why geolocation fails (and how to fix it)

DFS apps confirm your physical presence using GPS, WiFi positioning and cellular triangulation — not your billing address. False blocks almost always trace to a VPN, denied location permission, or weak WiFi signal. Fix: enable precise location, disable any VPN/proxy, restart the app, and switch to cellular data. Spoofing your location to play from a restricted state violates operator terms and can forfeit your funds.

Age restrictions by jurisdiction

The default minimum age for paid DFS is 18+, but several states set it higher: 19+ in Nebraska and Alabama, and 21+ in Arizona, Massachusetts and Iowa. Operators enforce the limit at registration based on your state of residence, so there is no way around it. If you are below your state's threshold, you cannot legally enter paid contests there.

Find your operator

Once you have confirmed DFS is legal where you are, compare live sign-up offers on the real-time matrix and claim a code: DraftKings, FanDuel, Underdog, Sleeper or BetMGM.

Frequently Asked Questions

Is daily fantasy sports legal in the United States?
DFS is legal and regulated in the large majority of US states — currently around 41 in our tracking — but a handful restrict or do not offer paid contests. Legality is set state-by-state and changes with legislation, so always confirm your state before depositing.
What is the minimum age to play DFS?
The minimum age is 18 in most states, but it is 19+ in Nebraska and Alabama and 21+ in Arizona, Massachusetts and Iowa. The age requirement is enforced at registration and applies regardless of operator.
Why does my DFS app block me even though my state is legal?
Operators verify your physical location, not your billing address. A VPN, disabled location permissions or weak WiFi positioning can cause a false block. Enable precise location, disable any VPN, and use cellular data to fix it.
Which states do not offer DraftKings or Underdog?
Availability differs by operator even within legal states. States like Nevada, Idaho, Washington and Utah are common gaps for paid DFS. Check the operator's own state list at sign-up, as our table is a general reference.
